At the Annual General Membership Meeting, our registered Band Members received key information regarding the Flood Claim Settlement. The Flood Claim Negotiations Team was in attendance to provide detailed information that included the historical and cultural context of the flood claim, land surveys and appraisals, a breakdown of the proposed financials, a plan for distribution, and legal details around the two remaining and outstanding agreements that will form part of the settlement.
Our membership was informed that the only remaining work that needed to be done involved the drafting and finalizing of the legal wording and clauses contained within the Settlement and Easement Agreements. This is work that must be done by the lawyers. Once these two documents have been finalized and agreed to by all three parties, then we will be able to move on to a referendum and our Band Members will have the opportunity to vote on whether or not to accept the offer.
Due to our Negotiations Protocol regarding confidentiality, we have continued to diligently remind our membership of the importance of not disclosing any of the information regarding the Claim presented at the AGM. Unfortunately, it has come to our attention that certain individual(s) have posted some financial details online. Again, we strongly remind our members that releasing information may jeopardize our flood claim, as we do not have an agreement in place yet and until we do, we are bound by confidentiality. It would be tragic for many years of work, negotiations, and waiting to go to waste due to a breach.
Once again, we respectfully insist that our members refrain from posting information pertaining to our Flood Claim on any social media sites. Once material is posted, it can continue to be circulated in many ways even if you delete it.
On a positive note, we were very pleased that the majority of the membership attending this meeting expressed much joy and appreciation of the proposed settlement numbers. This is encouraging as we believe it will be favourable to all concerned. Chief and Council thank you for your continued support and patience. It has been a very long, tiring process, which has consumed much of our effort and time.
CURRENT UPDATE- As of September 26th 2016
Please note that since the June AGM, we continue to press on with bi-weekly conference calls and meetings with Ministers and key officials, with the aim of finalizing the remaining legal documents as soon as possible. It is reasonable to say that we look forward to seeing this finalized this year.
As stated by our legal consul at the AGM, the final two documents need to be worked on and agreed to by all parties. It is now up to the lawyers to complete this final process and come up with the acceptable wording in the Easement and Settlement Agreements. Although they were hopeful that they could complete these documents in July-August, they have experienced some delays due to bureaucratic red tape, vacation schedules, and other work commitments. We have been assured that they are nearing the final drafting of these documents and have made good progress.
As stated previously, once these lengthy documents have been accepted by all three parties, we will go to a referendum vote. We appreciate your patience regarding these delays. We understand and acknowledge the frustration that people may be experiencing, but rest assured, we will get this done.
Your Chief and Council have commitments from all levels of governments that our file is a priority. The lawyers are also committed to diligently getting their work done.
We have also been made aware that there are several inaccurate and false rumours circulating via social media regarding our flood claim. We can only reassure our membership that these types of false statements and rumours serve nothing but to cause further anxiety or distress and are unwarranted.
In closing, we would like to say Chi Miigwetch for your support and patience. We will notify the membership once these documents have been signed off and we move on with the Referendum.
