LDMLFN Flood Claim - Frequently Asked Questions and Answers 

The First Nation has prepared this document which contains some recently asked questions by its members and the corresponding answers to those questions.   

Question:      The LDMLFN members voted in favor of accepting the Settlement Offer. What does that mean?

Answer:         The First Nation is excited for its membership as the members overwhelmingly demonstrated their support by voting, almost unanimously, to accept the Settlement Offer.  This is virtually unprecedented in terms of obtaining such a high percentage of positive votes.  It clearly shows that our people unquestionably understood what they were voting on and what they wanted.   

Question:      What happens now that the vote is over and what are the next steps? 

Answer:         We must still follow INAC’s regulations on Referendums.  There is a seven day appeal period following the close of voting, whereby an elector can submit an appeal if they believe that (a) there was a contravention of these Regulations that may affect the results of the referendum; or (b) there was corrupt practice in connection with the referendum.

Once the appeal period has passed without any significance, we can then continue to move forward with obtaining the necessary signatures on the documents.  Your Chief and Council will be the first to sign off on the documents.  It will then go to Ontario for two Ministerial signatures following Ontario’s second appearance at the Treasury Board.  Lastly, it will go to Canada for the Minister of Aboriginal Affairs to sign off on.  This final signature triggers the 45 day requirement to have the monies put into the First Nations Bank account.

 Question:      When is the earliest date that the individual member’s portions will be deposited into their accounts?

 Answer:         Your Chief and Council recognize that their members have patiently waited a long time for this settlement, and for closure and healing to take place.  They are committed to expediting this process for their members.  They have made arrangements whereby the First Nation has been pre-approved by the bank in order to “bridge finance” the “member’s only” portion.  This will enable the members to receive these monies as quickly as possible and reduce the wait time. If all goes well, we are optimistically looking towards this happening sometime around the second week of May 2017.

 Question:      Our membership appears to be growing.  The INAC site shows our First Nation with 652 members as of March 2017.  What accounts for this growth? Have we allowed people to transfer in from other First Nations?

 Answer:         We are pleased to say that our membership is growing! This is basically due to our children and grandchildren becoming registered through Bill C-31 and more largely Bill C-3.  INAC’s process of registration can be a lengthy one, and it may take years for individuals to obtain their status due to the backlogs in registration.

 We would like to take this opportunity to state that your Chief and Council have only accepted six (6) individual transfers into LDMLFN since 2008.  Three of these individuals were adults and have either extensive family ties/blood-lines to LDMLFN or were registered before and had transferred out in the past. The remaining three individuals were children with the same extensive family ties/blood-lines to LDMLFN.

 We have a comprehensive list of criteria, which people who express an interest in transferring into or back into our First Nation, must meet.  All members of Council must also unanimously agree on the acceptance.  We currently have a small waiting list of individuals who have expressed a desire to transfer back into the band.  We will be reviewing these requests later this year.
